By using our website you have agreed to accept these Terms & Conditions and our Data Notice, managed in accordance with the Data Policy, below

We may make non-material changes to these policies and notices without letting you know, you also agree to check this page for any changes from time to time.  You will be invited to agree with any material changes to our agreement before they are effective.

Parties

The Baby Care Academy is the trading name of the business located at, Eaglescliffe, Stockton on tees, TS16 0JQ.

Your details will be as per the form that you will send us on enrolment of our courses or on any order for products.

Instalments

If we have agreed that you can pay for any products or services by instalment, you agree that in the event that you do not complete the payments, or if an instalment is late, The Baby Care Academy can demand payment of the outstanding balance which will become payable as a debt and/or require you to return all materials supplied. We reserve the right to demand full payment of outstanding amounts on the default of any one monthly instalment.

In the event of defaulting on a payment, we will write to you to request you make payment of the instalment amount. If we do not hear from you within 14 days of requesting payment, we reserve the right to remove you from the course and no longer mark your work or provide the tuition.

In the event that we demand the return of any materials supplied, you hereby agree that you will not make any copy of the materials or make use of any copies or other materials derived from those being returned.

No course certificate will be provided (if otherwise appropriate) if there are any outstanding fees due to The Baby Care Academy in relation to that course or program.

We reserve the right to remove you from any The Baby Care Academy social media group or to suspend communication with you while any money is outstanding and/or to send details of any debts to a factoring or other debt collecting agency.

Descriptions of products

We make every effort to show and describe our products as accurately as possible, however, slight variations may occur.

All quoted weights, dimensions and capacities are for guidance only. Colours of items viewed on a computer monitor can vary from the actual product depending on the calibration and colour settings of individual computer screens.

If you are unsure of your computer’s colour settings, refer to the user manual or seek advice. We cannot accept responsibility for errors resulting from poorly adjusted monitors.

Returns, Refunds & Cancellations For Online Courses/Digital Products

Please be aware that due to the immediate delivery of our online and digital courses we are unable to offer any refunds.

Please, therefore, make absolutely sure that before you enrol on any of our courses that you take the time to research it fully by reading the full course description and content and have taken all steps necessary to ensure that this is the right course and training provider for you.  If you are unsure then Clare Marie is available for a call and you can email any questions to [email protected].  We are unable to offer any refunds after enrolment.

Under this policy, you may cancel your purchase of the course within the period of 14 calendar days from the date on which the contract of purchase is concluded. This is called a "Cancellation Period". Note that if you redeem your voucher during the Cancellation Period, you expressly request us to begin providing the course materials and you acknowledge that you lose your right to cancel the purchase of the course and get any refund for it.
The only way to get a refund is if the course was missold. In those circumstances, REED will investigate and confirm with you what happened and make a decision.
 

Offers

From time to time you may receive offers relating to our courses, once enrolled on a course and payment for the course has commenced, you are not able to access any other discount code or special offer on the course you are enrolled on and have paid for.

You cannot use two separate codes or offers on the same product.

We reserve the right to withdraw any offers that you may have received in error in the event of any dispute.

 

Prices & Payment

All prices are correct as they appear on the website. We may change prices from time to time or have offers available for a limited time.

We will supply the goods to you as per your order, in accordance with these Terms and Conditions.

This website, it's content and any orders placed via the site are governed by and in accordance with English law. By placing an order with The Baby Care Academy you hereby agree to submit to the sole jurisdiction of the courts of England and Wales. The Baby Care Academy is liability for any claim howsoever arising shall not exceed the price of the goods supplied by The Baby Care Academy, to the customer: The Baby Care Academy shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way.

Your statutory rights are not affected by this statement.

It applies to all students, customers, clients, suppliers of and volunteers for The Baby Care Academy Its purpose is to ensure that The Baby Care Academy complies with the law and with high data protection standards.

The Baby Care Academy Students, Graduates & Teachers

As a student, you hereby consent to The Baby Care Academy processing and retaining your personal data for the purposes of enrolling you and managing you during your course and keeping in touch with you after you have graduated. Students, graduates and teachers also agree that we can process your data to keep you up to date about events and other news and/or to inform you about any special offers from The Baby Care Academy. This will also enable us to inform you about any changes in professional practice.

Visitors to our website and customers

Where you have provided your email in relation to creating an account, purchasing a product or signing up to receive a free download of any materials, we will store your email address to send you information about our services to keep you up to date about events and other news and/or to inform you about any special offers from The Baby Care Academy.

If you sign up to join our mailing list, you hereby agree to keep you up to date about events and other news and/or to inform you about any special offers from The Baby Care Academy.

You can withdraw your consent and request erasure of your data at any time by informing us in writing (however any student withdrawing their consent will not be able to graduate and may not be entitled to a refund of any fees paid or a waiver from any fees due).

The Baby Care Academy shall not collect or store your personal data for anything other than the purposes above.

This data protection policy regulates how The Baby Care Academy processes and stores personal data of its members.

It applies to all employees, officers, members and volunteers. Its purpose is to ensure that we comply with the law and with high data protection standards.

The Baby Care Academy processes, retains and shares personal data of members for the purposes set out in the Data Notice above.

Your data rights

You may request that we provide you with a copy of all personal data that we hold about you. We shall provide a copy of all information in accordance with our legal obligations and we will rectify any incorrect personal data held by us about you upon being notified of any mistakes.

Sharing data with third parties

We store data in our secure drive on Google and our computer system is backed up by PC world’s Cloud Storage system, Know-How. Where you have consented to join a whats app phone group, your information will be added to a whats app. Where you have requested to join a Facebook group, your information will be held by Facebook.

Review

We shall periodically review the security of our records and processing activities and shall take appropriate steps to ensure the confidentiality, integrity and availability of personal data that we hold.

Withdrawal of Support

For clarity I have set out the following;

I am here to help you develop your business but as a teacher, you are not able to use our materials and resources to set up a teacher training organisation.

If you want to set up your own training school, you will be asked to leave the community group and return all resources and lifetime access to the course will be revoked.

Using the names of the programs directly for your own trainings is not permitted.

 

Heart Led Healers Diploma Ts and Cs

 

We state that you will receive any additional courses we offer in the future, but we do not guarantee the the courses will be guaranteed to be released on certain dates or times, the process moves around due to study course details and the accreditation process, which requires some bath and forth between us the company and the accreditation body. 

The value of the courses that are ready to start is always over the price and value of the price charged, so you are never paying for something you are not receiving. 

We have full authority of when we release courses and choice of which courses to release. 

Please make sure you are happy with the courses you are purchasing at the time of purchase and not purchasing the Diploma with a hope to study a future course we plan to offer. 

 

Lifetime Access

Lifetime access means you will have access to the course material for the lifetime of the course. If we chose to remove or develop a course we will give 6 months notice to download all the course materials and/or complete the course work to receive the qualification. After this time we will still mark assessments and final practical assessments that are in relation to the course. 

 

Certificate Production on Payment Plan Failure. 

Certificate Production: The certificate for the course will not be produced until the total payment made towards the course reaches or exceeds £100 (or an equivalent amount in the specified currency). The certificate is a recognition of completion or achievement and will only be issued upon meeting this payment threshold.

One-time Fee Option: If you choose to pay a one-time fee that is equal to or greater than £100 at the time of enrollment, the certificate will be produced upon successful completion of the course requirements, without any further delay.

Payment Plan Duration: If you opt for the payment plan and do not choose the one-time fee option, the certificate will be produced once the cumulative payments made during the payment plan reach or exceed £100. The length of time it takes to accumulate this amount will depend on the agreed-upon payment schedule and the frequency of your payments.

Payment Obligations: It is your responsibility to ensure that all payments are made on time according to the agreed-upon payment schedule. Failure to make timely payments may result in the delay of certificate production.

Course Completion Requirements: The issuance of the certificate is contingent upon successful completion of all course requirements, which may include but are not limited to, attending all required sessions, completing assignments, passing assessments, and fulfilling any other criteria specified by the course provider.

Modifications: The course provider reserves the right to modify these terms and conditions at any time. Any changes will be communicated to you through the provided contact information or by posting an updated version on the course platform.

 

Work Marking Suspension inline with Payment Plan Failure. 

Work Marking Suspension: If you fall behind on payments and become overdue, none of your work, assignments, or assessments will be marked or evaluated until you bring your payment plan up to date and fulfill all outstanding payment obligations.

Reinstating Work Marking: Once you have caught up with your payment plan and fulfilled all overdue payment obligations, the marking of your work will resume. However, please note that any delays in payment may have affected your progress.

Access to Course Materials: In the event of non-payment, the course provider reserves the right to temporarily or permanently restrict your access to course materials, including lectures, modules, resources, and support services until your payment plan is brought up to date.

Certificate Issuance: Failure to make payments in accordance with the agreed-upon payment schedule may also result in the delay or withholding of the certificate until all outstanding payment obligations are fulfilled.

Late Payment Fees: In addition to the suspension of work marking and access to course materials, late payment fees may be imposed for each missed payment or for payments received after the agreed-upon due date. The specific amount and terms of these fees will be outlined in the payment plan agreement.

Remedial Actions: If you continuously fail to meet your payment obligations and do not respond to attempts by the course provider to resolve the issue, further remedial actions may be taken, such as the termination of your enrollment or the referral of the matter to a collections agency. Any costs or fees incurred as a result of such actions will be your responsibility.

Communication: It is important to maintain open communication with the course provider in the event of financial difficulties or unforeseen circumstances that may impact your ability to make payments. Early notification and discussion of the situation may lead to potential alternative arrangements or accommodations.

 

Suspension of Bonuses in line with Payment Plan Failures.

Bonus Eligibility: To be eligible for the bonuses, including 1-to-1 coaching or any other additional benefits, you must meet the payment deadlines as specified in the payment plan. If you fail to make payments by the designated due dates, you may forfeit the right to receive or continue to receive these bonuses.

Suspension of Bonuses: If you become overdue on your payment plan, the course provider reserves the right to suspend or temporarily revoke access to the bonuses associated with the diploma until your payment plan is brought up to date.

Reinstating Bonuses: Upon bringing your payment plan up to date and fulfilling all outstanding payment obligations, the bonuses associated with the diploma will be considered to be reinstated. However, please note that any delays or suspensions may affect the availability or timing of these bonuses, and their delivery will be subject to the discretion of the course provider.

No Retroactive Bonus Eligibility: If you regain compliance with the payment plan after a period of non-payment, the bonuses that were missed during the non-payment period may not be retroactively granted. Bonus eligibility will resume from the point at which your payment plan becomes current and up to date. 

Communication: If you encounter financial difficulties or anticipate issues with meeting payment deadlines, it is important to communicate with the course provider promptly. Open communication may allow for potential alternative arrangements or accommodations, although the course provider is under no obligation to grant such arrangements.

Modification or Removal of Bonuses: The course provider reserves the right to modify or remove bonuses associated with the diploma at their discretion. Any changes will be communicated to you through the provided contact information or by posting an updated version on the course platform.
